Exceeding the maximum speed by 20 km / h on secondary roads when overtaking will continue to be legal with the reform of the Traffic Law,
There is an assumption in which it is allowed to exceed the maximum speed established on conventional roads. These are the famous (and controversial) 20 km / h extras that are “forgiven” if we are trying to overtake on this type of road.
Till the date it was rumored that this margin was going to be removed at the time of passing another vehicle and that it was going to be marked that way in the reform of the Law on Traffic, Circulation of Motor Vehicles and Road Safety.
The DGT, against maintaining this license
However, this proposal of the General Directorate of Traffic (DGT) will be postponed from the amendment of the law. Thus, it will continue to be allowed to exceed the speed of the user we want to pass. “>
However, this proposal of the General Directorate of Traffic (DGT) will be postponed from the amendment of the law. Thus, it will continue to be allowed to exceed the speed of the user we want to pass.
Ciudadanos, ERC, Plural and Vox presented a series of amendments to maintain that extra margin of 20 km / h At the time of advancing and the Committee on the Interior of Congress seems to agree that the regulations should not be touched in this regard.
The current rule allows drivers to exceed the maximum speed established in the section by a maximum of 20 km / h when trying to overtake another vehicle. This allowed only on conventional roads, where the maximum speed is 90 km / h. For this reason, a vehicle can reach 110 km / h while performing the maneuver, having to return to 90 km / h once it is finished.
The DGT that does not want to completely eliminate this prohibition, although it could delay it, justifies the measure as a safety issue and thereby reinforce the message that this maneuver increases the risk of a frontal collision.
The guide that clarifies the new speed limits
From the Spanish Foundation for Road Safety (FESVIAL) they also agree to suspend the possibility of exceeding the speed limit of the road when overtaking. According to this organization, “when speed is exceeded by 20 km / h, it certainly takes a few seconds less to carry out the overtaking maneuver, but it is known that this also “encourages” to exceed the speed in more than 20 km / h real, forces a strong attention to the speedometer to the detriment of other stimuli, and above all, it can “encourage” some drivers to overtake in less safe areas, -such as sections where there is low visibility-, instead of waiting to do so, for For example, in the areas of long straights ”.
