A new proposal by the Government of Mexico, and presented to the Chamber of Deputies, will reinforce the measures of the Tax Administration Service (SAT), as far as seizure of bank accounts is concerned.

According to the initiative, the SAT intends to apply said embargoes to “Third parties”, that is, not only taxpayers, but to those involved who oppose to the review or verification of tax years.

The initiative seeks oblige the « third parties », those who run deductions or take advantage of services from the calls billing companies, to collaborate with the SAT.

The called billing companies pay payroll to supposed employees, but they do not make the corresponding tax payment, that is, they do not turn the income tax withholding.

“Many of these companies apparently hired people who did fee services, for which they paid and withheld their ISR but it was never paid. In total, 55.125 million pesos stopped entering the SAT ”, explained Raquel Buenrostro, head of the Tax Administration Service during a press conference on June 23.

According to Buenrostro, at least 3,083 firms and more than 5,000 individuals received billing services in 2017.

According to the newspaper ReformaIt is also intended to change the order of priority of the assets to be seized, in order for the Treasury to act first on bank deposits or investments; second, on accounts receivable, stocks or bonds; and third, on cash or precious metals, and only fourth on real estate.

Currently, Congress to reform Article 40-A of the Federal Tax Code (CFF), puts real estate in the first place for precautionary seizure purposes, while bank deposits, which are much easier to locate and insure, They are in the sixth place of priority.

Billing companies that were denounced by the SAT

In June of this year, a document reflected the names of at least 3,083 firms that sought the services of the billing companies, including names such as: General Motors, Grupo Posadas, Monex, Club Atlante, Grupo Bimbo, according to the newspaper Milenio.

The dependencies with the highest debts are: SEP, 40 million 291,000 pesos; the Ministry of Health, with one million 140,000 pesos; Conagua, 699,000 pesos; Pemex, with one million 30,000 pesos; the IMSS, with 734,000 pesos; Conagua, 699,000 pesos and the National Lottery, 2,889 million pesos.

While the UNAM it is located with an amount of 3,717 million pesos; the Government of the CDMX, with 29,324 million pesos; the INAI, 50,616 pesos; Graphic Workshops of Mexico, 776,000 pesos, and Federal Roads and Bridges, 3,270 million pesos.

In other entities such as Sinaloa, there is the Coppel store, with two million 673,699, as well as Capufe, in Morelos, with three million 270,027 pesos.

Among the firms there is also: Unilever México, with 15.908 million pesos; Atlante club, 147,000 pesos; General Motors, 7,894 million; Parisian Group, 33,849 million; Sony Mobile, 43,659 million; Lux Inteligencia, with 77,262 million, and Modatelas, 124,000 million pesos.

A few months ago, the Tax Administration Service (SAT) announced how companies that commit fraud operate and who are those who will receive a notice to regularize their situation by issuing false invoices before the tax authority.

In June, the Attorney General’s Office presented 7 complaints against 43 companies accused of tax fraud and money laundering.
